Durham International Dispute Resolution Institute (DIDRI) was pleased to host a special book launch event for Dr Can Eken’s “Third-Party Funding (TPF) in Investment Arbitration”. TPF presents complex procedural and ethical challenges, which some jurisdictions and arbitration centres are now addressing through evolving laws and rules. With the development of international commercial and investment arbitration, interesting cases have also arisen over the years.
The author, Dr Can Eken, presented his newly published book, based on his PhD thesis at the Chinese University of Hong Kong.
The book provides a comprehensive analysis of TPF and includes important empirical data from interviews with nearly thirty people working for third-party funders. Dr Eken also offers a detailed guideline to tackle procedural and ethical issues associated with TPF, shedding light on these under-researched aspects and offering essential legal guidance.
They were pleased to have Professor Lei Chen and Dr Ronán Feehily as commentators for the event. Both provided analytical and thoughtful perspectives: Professor Chen highlighted the practical applications of TPF, while Dr Feehily explored the ‘rule of law’ underpinning this evolving legal field. Students from diverse backgrounds actively participated, raising questions that ranged from ‘access to justice’ to the ‘financial incentives of TPF’.
