Law Applicable to Arbitration Agreements: Insights from UniCredit Bank GmbH v RusChemAlliance LLC

The session will provide an overview of the UniCredit judgment and place it within the wider context of the rules governing the law applicable to an arbitration agreement. This area is highly topical due to the Law Commission’s recent reform proposals to the Arbitration Act, which have translated to the Arbitration Bill currently being debated in parliament after forming part of the King’s Speech.

The issue of which law applies to an arbitration agreement can have significant implications in practice and a firm grasp of topics such as this often sets arbitration specialists apart from more general practitioners.

Bio: Georg Stigelbauer is an associate in the International Arbitration Team at Covington & Burling. His experience covers a broad range of contentious matters, including international commercial arbitration, investor-state as well as state-state disputes, and enforcement proceedings in the courts of England and Wales. Georg has also served as a Judicial Assistant in the Chancery Division of the High Court of England and Wales. His most recent experience includes representing Ukraine before the Permanent Court of Arbitration in a dispute with the Russian Federation under the United Nations Convention on the Law of the Sea.

Bio: Dr Can Eken is an assistant professor at Durham Law School, Durham University and co-director of the Durham International Dispute Resolution Institute (DIDRI). His research and teaching mainly focus on international commercial arbitration, investment law and third-party funding. Dr Eken is admitted to practise law as an attorney in California, Turkiye, and as a solicitor in England and Wales. He is also a Fellow of the Chartered Institute of Arbitrators. He was a visiting scholar at Stanford University, the Max Planck Institute in Luxembourg and Singapore Management University.
