This volume presents a comparative examination of the issue of fault in criminal law. Extant law reveals significant problems in adoption of consistent approaches to doctrinal and theoretical underpinnings of fault liability and culpability thresholds in criminal law. This has been exemplified by a plethora of recent jurisprudential authorities revealing varying degrees of confusion and vacillation. This collection focuses on fault liability for inculpation with contributions from leading specialists from different jurisdictions presenting alternative perspectives. The book addresses three specific elements within the arena of fault, embracing an overarching synergy between them. This structure facilitates an examination of UK provisions, with specialist contributions on domestic law, and in contrasting these provisions against alternative domestic jurisdictions as well as comparative contributions addressing a particularised research grid for content. The comparative chapters provide a wider background of how other legal systems treat a variety of specialised issues relating to fault elements in the context of the criminal law. With contributions from leading experts in the field, the book will be an invaluable resource for researchers, academics, and practitioners working in this area.
Chair in Global Law and SETI Policy
Professor Bohlander is the Chair in Global Law and SETI Policy at Durham Law School. He has practical and scholarly expertise in German, English, comparative, and international criminal law, and a recent interest in legal issues surrounding the Search for Extraterrestrial Intelligence (SETI). He is the International Co-Investigating Judge in the Extraordinary Chambers in the Courts of Cambodia, serving as a full-time judge in Phnom Penh from 2015 – 2019, and again part-time since April 2020.

In October 2021 Alan was appointed Deputy Faculty Pro Vice Chancellor for Research and Knowledge Exchange in the Faculty of Business and Law, and this portfolio has extended recently to cover important EDI responsibilities, aligned with the Faculty EDI Director and Leads. He has published over 180 monographs, textbooks and articles in the substantive arena in leading journals in England, Australia, Florida and Los Angeles, and since 2005 has been entered in Who’s Who in American Law.
Associate Professor in Law, Lincoln Law School, University of Lincoln
Dr Andra le Roux-Kemp' research focus is in Global and Comparative Law, and her primary fields of inquiry are Criminal Justice (including Forensic Law), and Medical and Health Law (including Medical ethics and Bioethics). Her scholarly approach can be described as transdisciplinary; focussing on the intrinsic complexity of law and legal systems, whilst also recognising the inevitable synergy of law with other knowledge spheres. She is the author of the Hong Kong Criminal Justice Series.
Emeritus Professor of Law, UCL
Bob Sullivan’s principal research interests are substantive criminal law, criminal law theory, corporate criminal responsibility and criminal and civil law responses to serious fraud. He is an emeritus professor at University College London. Formerly, he was professor of law at Durham, Barber Professor of Jurisprudence at Birmingham, and professor of criminal law at Sussex.
